General conditions of sale
1- Preamble
These General Terms and Conditions of Sale are concluded between, on the one hand, the company Basaltik, holder of the domain name basaltik.fr, EURL with capital of 1,000 euros registered with the RCS of Angers under number 950 823 823 – NAF 23.41Z – SIRET 950 823 823 00014 – Intra-Community identification number / VAT Identification FR 47 950 823 823 whose registered office is established in France, at 5 impasse de la tour, 49410 St Laurent-du-Mottay, publisher of the site www.basaltik.fr, and hereinafter referred to as “Quentin Colas” according to the name of its manager, on the other hand, any natural or legal person visiting or making a purchase on the site www.basaltik.fr, and hereinafter referred to as “the Customer”.
2- Definition
The following definitions apply in these general conditions of sale according to the meaning indicated below (whether used in the singular or the plural).
- “General Conditions of Sale”: means this document, i.e. the terms and conditions applying in the relationship between Quentin Colas and the Client.
- “Order”: means the Customer’s purchase order for one or more Product(s) placed using the Website.
- “Site”: means the website accessible at the address www.basaltik.fr, published by Quentin Colas.
- “Product”: means a product offered for sale on the Website, on the day the Customer consults the website. Our Product offers and prices are valid as long as they are visible on the Website, within the limits of available stocks. Errors or modifications may exceptionally exist, particularly in the case of simultaneous orders of the same Product by several Customers. Quentin Colas assumes no liability in the event of stock shortages or unavailability of Products for orders not yet accepted by Quentin Colas.
- “Customer”: means a natural or legal person, consumer and/or professional, who uses the Website and acquires one or more Product(s), for their personal needs, through the website, having previously accepted the General Conditions of Sale.
- “Recipient” means the natural person designated by the customer to receive the order.
3- Completeness
These terms and conditions express the entirety of the parties' obligations. In this regard, the Customer accepts in advance and without reservation all the provisions set out in these general terms and conditions. In the event of disagreement with the terms and conditions of the General Terms and Conditions of Sale, the Customer must not use the Website.
No general or specific conditions appearing in the documents sent or delivered by the Client may be incorporated into these terms and conditions, provided that these documents are incompatible with these general conditions.
Quentin Colas reserves the right to adapt or modify these General Conditions of Sale at any time and without notice, the adaptations or modifications then being applicable to all orders subsequent to these adaptations or modifications.
In the event of modification, the General Conditions of Sale applicable to the Customer's order are those which were online, and which the Customer accepted on the day the Order was placed.
4- Object
These General Conditions of Sale aim to define:
- Contractual relations between Quentin Colas and the Client
- The conditions applicable to any purchase of products made on the Site www.basaltik.fr whether the Customer is of French or foreign nationality, or whether he is a professional or a consumer.
Any use of the Website and any placing of an Order for one or more Product(s) via the Website implies pure and simple acceptance of all of the General Conditions of Sale.
Only persons legally capable of entering into contracts concerning the Products offered for sale on the Site may place an Order on the Website. When placing an order, the Customer guarantees that they have full legal capacity to adhere to the General Terms and Conditions of Sale, place an Order and conclude a sale.
5- Duration
These conditions apply for the entire duration of the online publication of the products and services offered by the company Basaltik, holder of the domain name www.basaltik.fr.
6- Acceptance and opposition to the general conditions of sale
6.1. Accessibility of the general conditions of sale
Any Internet user can consult the general conditions of sale on the Site www.basaltik.fr by clicking on the hyperlink at the bottom of each page of the Site. The general conditions of sale may be subject to modification; the applicable conditions are those in force on the Site on the date the order is placed.
6.2. Legal capacity of the Client
A Customer, under the general terms and conditions of sale, is any legal entity or natural person, aged at least 18 years or having the authorization of the authorized person on the date of validation of their order. The Customer is a consumer or a professional residing in France or abroad. By paying for their order, the Customer acknowledges having full legal capacity to commit to the general terms and conditions of sale.
6.3. Acceptance of the general conditions of sale
The Customer acknowledges having read the general terms and conditions of sale and expressly declares to accept them as soon as he has confirmed his order on the site. Regarding orders not placed online on the Site (email, tel, etc.), the Customer acknowledges having read and expressly declares to accept the general terms and conditions of sale as soon as he receives and does not dispute his order confirmation email. By accepting the general terms and conditions of sale, the Customer accepts without reservation all the stipulations provided in these said conditions, to the exclusion of all others. The general terms and conditions of sale are those in force on the Site on the date of validation of the order by the Customer. The general terms and conditions of sale are valid for the duration necessary for the supply of the goods and services subscribed to, until the expiration of their guarantees.
7- Product characteristics and prices
7.1. Consultation of the characteristics of products and services
Quentin Colas presents on its Website the products and services as well as their detailed descriptions allowing the Customer to know, before placing a final order, their essential characteristics. The photographs of the products presented on the Website are as faithful as possible but cannot guarantee a perfect similarity with the products offered.
7.2. Availability of products and validity of the offer
A product that has become unavailable is indicated with the words: " SOLD OUT ". It is also specified that simply adding a product to the basket does not constitute validation of the order. In other words, the product may become unavailable between the time it is added to the basket and the validation of the order by the Customer. In the event that the unavailability of the product or service is noted after validation of payment, Quentin Colas undertakes to cancel the order and to fully refund the price paid by the Customer. In this case, the refund will be made without delay and at the latest within fourteen (14) days of payment of the sums paid by the Customer.
7.3. Prices
The prices of the products and services presented on the Site are indicated in Euros, all taxes included (TTC). They are applicable when the order is validated by the Customer and do not include the contribution to transport and packaging costs, invoiced in addition and indicated on the "Summary" page of the basket before the final validation of the order. The prices, all taxes included, include VAT (Value Added Tax) for products delivered within the European Union. Items subject to VAT are subject to French VAT. Any change in the legal rates of French VAT will be reflected in the price of the products and services presented on the Site, on the date stipulated by the implementing decree referring thereto. For sales made outside the European Union, customs clearance and the payment of various duties or taxes are the sole responsibility of the Customer.
8- Payment
All prices include VAT. The total amount of an order is made up of the price of the items and the shipping and handling fees. You can use the following payment methods: VISA, MASTERCARD, AMERICAN EXPRESS, APPLE PAY, BANK CARDS, and SHOP PAY. If the payment is declined by the authorization center, we will not be able to ship the order.
9- Order confirmation
You will receive a confirmation email as soon as we receive your order. Please have this email reference number ready for all correspondence. If you do not receive this confirmation email, please contact quentin.colas@basaltik.fr.
10- Right of withdrawal
In accordance with Article L121-20 of the Consumer Code, the Customer has a period of fourteen (14) clear days from receipt of the products to exercise their right of withdrawal, without having to provide reasons or pay penalties, except where applicable, return costs. Returned products must not have been used.
The fourteen (14) day period starts from the receipt of the products: when the fourteen (14) day period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the next working day. Quentin Colas recommends that the Customer who wishes to exercise his right of withdrawal informs Customer Service by email at quentin.colas@basaltik.fr.
11- Delivery
11.1 Delivery costs
The delivery costs dedicated to our online sales site have been established according to the volumes and weight of the product based on the current rates of the post office and our carriers.
11.2 Delivery times
11.2.1 Pre-sale products
All pre-sale products will be marked "PR SALE ." The delivery time will be indicated on each product sheet. This time is an estimate of the production and delivery time. Quentin Colas is committed to making every effort to meet these deadlines. However, production problems may arise and extend the initially planned delivery times. In this case, the customer may request either a refund for their prepaid products or wait for delivery.
11.2.2 Products in stock
Unless otherwise stated on the website, Quentin Colas will make every effort to ensure that the order is shipped within an average of 7 days after confirmation of the order. If one or more items are no longer available without this being indicated in the product sheet, the Customer will be notified by email or telephone and Quentin Colas will refund these items by crediting the card used to pay for the order. In the event of the workshop being closed, a pop-up message will inform of the reopening date and deliveries will resume from that date.
12- Conditions return of products
The Customer has a legal period of fourteen (14) days from the date of receipt of his order to notify Quentin Colas of his intention to return the product to us and the reason for this return.
The return of the product(s) must be made in their original packaging, intact, accompanied by all possible accessories and documentation, in perfect condition for resale, with the indication of the order number to which the products relate. The product must be returned in packaging provided for this purpose, not allowing the identification of the product (postal parcel, bubble envelope, kraft paper, etc.). Any product that is damaged, incomplete, missing or whose original packaging has been damaged, will not be refunded or exchanged and will be returned to the Customer. Quentin Colas recommends that the Customer return their products with a recommendation or additional insurance guaranteeing, where applicable, compensation for the products up to their actual market value in the event of theft or loss of the package(s).
The costs are the responsibility of the customer.
13- Reimbursement
In the event of exercising the right of withdrawal, Quentin Colas is required to reimburse the Customer for the amounts paid, without penalty, with the exception of shipping costs. The reimbursement is due without delay and at the latest within fourteen (14) days following the date of receipt of the returned products. If the return of the purchased product(s) is due to an error on the part of Quentin Colas, the shipping and return costs will then be fully reimbursed to the Customer.
14- Cancellation
Beyond this withdrawal period, if you wish to cancel your order, you must contact quentin.colas@basaltik.fr. If your order has been shipped, we will ask you to return the products to us by following the instructions provided by email.
15- Modification of your order
If you would like to make changes to your order, modify the delivery address, or add products, please contact us by email at quentin.colas@basaltik.fr.
16- Guarantees
16.1. Transport warranty
Assuming all transport risks, Quentin Colas undertakes to deliver the products ordered by the Customer in sealed, sturdy packaging that is appropriate for the contents and transport requirements. Any product damaged or lost during transport will be replaced. The transport guarantee is only valid if the Customer or the Recipient has signed the delivery note or transport receipt presented by the carrier on which he has taken care to issue precise, dated and signed handwritten reservations. By signing the delivery note or the transport receipt, without making any reservations, the Customer acknowledges that their package was not damaged during transport. In the event of a dispute, the original packaging must be kept until the dispute is resolved. Quentin Colas advises the Customer or the recipient to inform Quentin Colas by email quentin.colas@basaltik.fr within a maximum of 48 hours from delivery; after this period, no complaints will be considered.
16.2. Customer Complaint
The implementation of the guarantees must be the subject of a request made by email or by telephone to Customer Service by email at quentin.colas@basaltik.fr or by telephone at 0685889625. The claim must be justified and accompanied by proof of the damage suffered (photos, etc.). The Customer must also indicate whether they wish the product to be replaced or refunded.
The product photographs presented on the Site are as accurate as possible but cannot guarantee perfect similarity with the products offered. As each piece is handmade, it is normal for there to be variations between pieces.
NB: Complaints or disputes will always be received with attentive goodwill, good faith always being presumed in the person who takes the trouble to present the dispute.
17- Applicable law
The General Terms and Conditions of Sale are subject to French law. In the event of a dispute, the Customer may submit their complaints to Quentin Colas by email at quentin.colas@basaltik.fr or by telephone at 0685889625 in order to seek an amicable solution. In the absence of an amicable agreement between the Parties, the dispute will be submitted to the French courts, which shall have sole jurisdiction in this matter.
